DMCA Takedown Policy

Our company, FairTech OU, is based in Europe, Estonia. However, we have decided to comply with the Notice and Takedown provisions of the Digital Millennium Copyright Act (hereinafter referred to as – “DMCA”) voluntarily.

Also, FairTech OU complies with Directive (EU) 2019/790 of the European Parliament and of the Council of 17 April 2019 on copyright and related rights in the Digital Single Market and amending Directives 96/9/EC.

If you have found content published on FairPay (fairpay.to or fairpay.network) that is infringing the intellectual property rights of copyright holders, please read through to learn how to report and get assistance from us.

All DMCA notices and counter-notifications must be written in the English language. Notifications written in whole or in part in another language will be dismissed.


How to submit a DMCA notice:

If you believe that someone has published your content on fairpay.to or fairpay.network while infringing your copyrights, please reach out to us at dmca@gofairpay.com.

Please include the following information so we can assist you:

  1. The URL(s) associated with the content being infringed (or alternatively, if you cannot find the URL(s), you can describe where the content is located on our website);
  2. A description of the content (or other intellectual property) that has been infringed according to you;
  3. A declaration from you indicating a sincere belief that the contested usage is not sanctioned by the copyright holder, its representative, or the law;
  4. Proof that you are the owner of such intellectual property, such intellectual property is registered and associated with you;
  5. Your address, phone number, and email address (if you have a representative, provide the data of the legal entity or person you are acting on behalf of);
  6. A signature (possibly electronic) of the person authorized to act on behalf of the owner of the copyright;
  7. A statement that the above information in your notification is accurate and that you are either the copyright owner or its authorized agent.

FairPay DMCA takedown procedure:

Following the section DMCA 17 USC 512 (c) of the DMCA, FairPay has a “notice-and-takedown” process. This means that we remove access to alleged infringing material upon receipt of a valid DMCA notice from a copyright owner.

We must act in the following manner to keep our status as a Service Provider and our related statutory immunity under the DMCA (“Safe Harbor” protection). Please know that we take copyrights & intellectual property seriously, and we will take action against anyone abusing DMCA notifications to harm a content creator’s business.

If your content has been removed from FairPay following a valid DMCA Notice we received, then you may submit a counter-notification to dmca@gofairpay.com.


How to submit a DMCA counter-notification:

If you believe we have received an erroneous or false DMCA notice affecting your content and/or that we have wrongly removed or disabled some of your content from our sites while following DMCA rules, you are allowed to submit a counter-notification pursuant to Section 512(g)(2) & (3) of the DMCA.

To submit a counter-notification, please reach out to us at dmca@gofairpay.com. Please include the following information so we can assist you:

  1. The URL(s) associated with the content you claim has been wrongly reported (or alternatively, if you cannot find the URL(s), you can describe where the content is located on our website);
  2. A description of the content (or other intellectual property) that has been erroneously reported according to you;
  3. A declaration from you indicating a sincere belief that the removal or disabling of the content was done so erroneously.
  4. Proof that you are an eligible owner of the published content or you have a valid license to use such content;
  5. Your address, phone number, and email address (if you have a representative, provide the data of the legal entity or person you are acting on behalf of).

After receiving a DMCA-compliant counter-notification, we will provide it to the claimant who first sent the DMCA Notice. Then, within 14 (fourteen) calendar days, we will publish the content on our website again unless we receive a notice that a court action has been filed.
