FairPay - Acceptable Use Policy

You agree to this policy by using the Services - please read it carefully.

The Acceptable Use Policy applies to your use of FairPay and all Content on FairPay and forms part of your agreement with us.

This policy aims to establish what is and is not permitted on FairPay.

Any defined term in the Acceptable Use Policy has the same meaning as in our Terms and Conditions for all Users.

Not respecting the terms set forth in this Policy can lead to your account being terminated or suspended and access to your earnings being revoked.

1. Forbidden Content

Any content you submit, upload, post, display, or publish must:

Abide by our Terms and Conditions, including but not limited to this policy;
Be lawful in the place where you reside;
Be lawful in Estonia.

Estonian laws accept any content as long as it features consenting adults and respects human dignity, which is a somewhat vague definition.

What we can tell you for sure is that the following content is indeed prohibited:

Any presentation or representation of minors engaged in intimate physical conduct or sexual situations, including but not limited to lewd nude depictions, masturbation, or sexual conduct, actual or depicted;
Any portrayal of any performer that suggests or implies that the performer is under the age of eighteen (18) years old;
Illegal, defamatory, fraudulent, hateful, discriminatory, harassing, or threatening, or causes physical, mental or moral detriment to any person, or which encourages or promotes violence or any illegal activity;
Prejudice respect for human dignity, encourage behavior prejudicial to health or safety, unreasonably showing persons in dangerous situations, encourage behavior grossly prejudicial to the protection of the environment;
Exploit the trust of persons in others, directly urge persons to purchase or rent goods or services in a manner which exploits their inexperience or credulity, directly encourage persons to persuade others to purchase or rent goods or services;
Contains, promotes, advertises, or refers to hate speech (content intended to vilify, humiliate, dehumanize, exclude, attack, threaten, or incite hatred, fear of, or violence against a group or individual based on race, ethnicity, national origin, immigration status, caste, religion, sex, gender identity or expression, sexual orientation, age, disability, serious disease, veteran status, or any other characteristic);
Advertises, promotes, or facilitates illegal gambling;
Advertises cigarettes and other tobacco products, electronic cigarettes, and electronic cigarette refill containers;
Advertises or promotes illegal drugs or any prescription-only medicine;
Advertises, promotes, or encourages immoderate consumption of alcoholic beverages;
Content that promotes, advertises, involves, or refers to, either actual or simulated:

Bestiality;
Extreme violence, torture, sadomasochistic abuse, hardcore bondage, or extreme fisting;
Incest;
Defecation, or scatological related;
Non-consensual sex, rape, lack of consent, or sexual assault;
Illegal drugs or drug paraphernalia;
Intoxication or hypnosis of any of the performers;
Mutilation, self-harm, or suicide;
Necrophilia;
Animal abuse;
Prostitution, escorting, or sex trafficking;
“Revenge porn” (Content featuring individuals who have not given prior, express, and fully informed consent to that material being created and posted on FairPay is forbidden);
“Deepfakes” (Content containing fake or manipulated sexual content in relation to anyone else without his express consent);
Contains unsolicited sexual content or unsolicited language that sexually objectifies anyone in a non-consensual way;
Weapons (No firearms, explosives, knives, or other dangerous weapons, including realistic props);
Includes or promotes discrimination based on sex, racial or ethnic origin, nationality, religion or belief, disability, age, or sexual orientation;
Causes or is calculated to cause inconvenience or anxiety to anyone else or which is likely to upset, embarrass, or cause serious offense to anyone else;
Contains or refers to anyone else's personal data or private or confidential information without that person's express written consent;

You are not allowed to submit, upload, post, display, or publish content featuring sexual activities in a public place where members of the public are reasonably likely to see the activities being performed (you are allowed to publish content in outdoor places where members of the public are not present, for example, private property such as a private backyard, or secluded areas in nature where members of the public are not present).

We encourage you to be creative in what and how you sell, and you can find further information regarding prohibited content in the Help Center. But should you have any doubts in regard to content, please contact us prior to submission. Better safe than sorry.

It is strictly prohibited to use FairPay for payments related to escorting and/or prostitution in any way. Escorts also operating an online business, such as selling videos, are welcome to use the Services for this part of their business (and this part only).

2. Safety

We do our best to keep our Services safe for all users and keep any underage person far from them. But we can’t guarantee it. We need your help to ensure the best efforts are employed. By using the Services, you agree that:

You will only use FairPay in a manner and for a lawful purpose;
You will not use the Services for any purpose that is illegal or prohibited in these Terms;
You will not make the Services known to any person under 18 years old;
You will not submit, upload, post, display, or publish content that shows, includes, or refers to any other individual unless you have written documentation that proves that all individuals shown or included, or referred to in your Content are at least 18 years old, and you have a written consent from each individual to use their name or images (or both) in the Content;
You will not use or develop any third-party application that interacts with other users’ content or the Services without our written consent;
You will not use the Services in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services or that could damage, disable, overburden, or impair the functioning of the Services;
You will not knowingly introduce viruses, trojans, worms, or other malicious material into Content that is or may be technologically harmful;
You will not attempt to compromise the security of the Services;
You will not attempt to circumvent any content-filtering techniques we employ or attempt to access areas or features of the Services that you are not authorized to access;
You will not use any robot, spider, crawler, scraper, or other automated means to interface with or access the Services or extract other users' information;
You will not probe, scan, or test the vulnerability of our Services or any system or network; and
You will not encourage or promote any activity that violates these Terms.

3. Fair Usage

You shall not misrepresent any of the services we provide nor make any false or misleading statement to anyone about the services we offer pursuant to these Terms. Do not use FairPay to engage in misleading or deceptive conduct or conduct that is likely to mislead or deceive any other User.

You shall not impersonate us, one of our employees, another User, or any other person or company or falsely state or suggest any affiliation, endorsement, or sponsorship between you and us or any other person or company. Do not upload, post, display, or publish Content on FairPay that gives the impression that it comes from or is approved, licensed, or endorsed by us or any other person or company.

You shall not use FairPay’s name, logo, or any related or similar names, logos, product, and service names, designs, or slogans other than in the limited ways which are expressly permitted in our Terms and Conditions or with our prior written agreement.

You shall not use FairPay for payments related to escorting and/or prostitution in any way.

You shall not submit, upload, post, display, or publish Content that is used or is intended to be used as a way to extract money or another benefit from anyone else in exchange for the removal of the Content.

You shall not attempt to pass off recorded material as a live stream.

You shall not submit, upload, post, display, or publish Content that is spam, inauthentic, misleading, low quality, or with the intention or effect of artificially increasing any Seller’s views or interactions.

You must provide the services you sell to other users and are fully responsible for them. Those services are lawful and not harmful to you or any other performers. We will refund the paying user and deduct it from your earnings if a service is not provided.

You and your associates, employees, employers, and affiliates shall act, in good faith, in the best interest of FairTech OÜ and its employees, partners, service providers, customers, and affiliates.

You shall not violate any third-party rights, trademarks, or copyrights, in any way, in the content you submit to us or in any other interaction with us. You shall respect the intellectual property rights of the Sellers and not do anything that violates our or someone else’s rights, including intellectual property rights, personality rights, privacy, and data protection rights.

You shall not use FairPay to sell, rent, transfer, or share your account or any Content obtained from your use of FairPay to or with anyone else.

Until the termination of these Terms and for a period of three (3) years after, you agree that neither you nor anyone under your control or authority shall circumvent or attempt to circumvent FairPay to form or attempt to form any business relationship with any of FairPay employees, affiliates, sublicensees, or customers, that harms, injures or diminishes FairPay and/or the benefits that FairPay may reasonably expect to enjoy pursuant to the rights granted to FairPay in these Terms.
